| The
following terms & conditions refer to private print orders & private
commissions only. Terms & conditions for official print commissions by military squadrons or aviation groups differ. Please email enquiries@caricatureaircraftpictures.com for details. |

1)
SERVICE ALTERATIONS & UPDATES
"Caricature Aircraft Pictures" (from here on referred to as "C.A.P."), reserves the right to amend the terms & conditions of sale, fees, and remove any item or service from sale without prior notice. |

2)
COPYRIGHT ISSUES (ALL ARTWORKS)
The aircraft caricature design(s) and print product(s) remain the copyright and property of Robert Henderson & "Caricature Aircraft Pictures" AT ALL TIMES. The aircraft image and any additional artwork designed and produced by "C.A.P." may not be copied/altered and reproduced on any other items in any media whether physical or digital without actual written permission from "C.A.P.", and such actions/activities may also incur a licencing fee & legal contract to be made. Prints may be copied in whole purely for advertising purposes within related magazines / catalogues / brochures in order to advise the general public as to the availability of said items. Individuals and/or organisations found using and / or reproducing any artwork produced by "C.A.P." without prior contract of agreement signed by both parties will be prosecuted under the full extent of UK and / International law. |

FRAMES AND PICTURE MOUNTS (PRINTS & PRIVATE ARTWORK COMMISSIONS)
All artworks & prints are supplied without picture mounts and are unframed. |

4)
REFUNDS (ALL ARTWORKS & PRINTS)
All items, including original artworks and any deposits are non-refundable. |

5)
PRINT ORDERS & PAYMENT OPTIONS, U.K. & INTERNATIONAL CUSTOMERS
"C.A.P." welcomes international orders. All payments must be made in UK Pounds Sterling ONLY. Payment accepted by PAYPAL only please using the secure electronic shopping cart provided on the website. Goods cannot be dispatched TO ANY CUSTOMER unless payment (including shipping costs) has been recieved in full. |

DELIVERY TIMES FOR STOCK ITEM PRINTS (PRIVATE ORDERS)
UK print orders are normally dispatched with 10 working days (allowing for stock) upon payment clearance using the postal services as stated under the menu sub-heading "Postage & Shipping". Proof of postage will be obtained for all items sent. Exact delivery times outside the UK may vary. |

7)
CUSTOMS CHARGES (PRINTS & PRIVATE ARTWORK COMMISSIONS)
Customers may be liable to additional charges by individual countries customs/tax departments at destinations outside the United Kingdom. "C.A.P." has no authority and assumes no responsibility for any of these charges made to the customer. It is the customers responsibility to ensure that these extra charges are settled with the appropriate bodies. |

PRIVATE COMMISSIONS (SIDE PROFILES, PRIVATE COMMISSIONS)
Profile caricatures (private commissions) can be classed as either "personalised" or "standard". Personalised refers to artworks featuring items on the aircraft that are non-standard/fictitious items. Standard refers to aircraft that have been caricatures "as is" - i.e. as they would be seen in operation in the real world. "C.A.P." reserves the right to produce limited numbers of prints of "standard" caricature profile artworks for sale to the public. |

9)
ARTWORK DEVELOPMENT PROCESS & PAYMENT (ALL PRIVATE ARTWORKS)
After the initial enquiry has been recieved from the customer, written details and photographic reference material will discussed and collected by "C.A.P." from the customer for use in the creation of the commissioned artwork. Once all the data has been collected and the basic layout & details of the artwork has been agreed in writing via email, a final quote will be provided to the customer. Once the quote has been accepted, a design sketch will be produced and sent to the customer via email for approval. The customer may request alterations to the design at this point. Once the design has been approved and the go ahead for the final artwork has been recieved in writing by email, a deposit equal to 50% of the total artwork costs must then be received prior to work commencing on the artwork proper. Once the artwork is complete, a photograph of the finish painting will be sent to the customer via email. The outstanding balance of the artwork fees (including all shipping costs) should then be paid in full prior to the artwork being dispatched to the customer. Alterations to the final colour artwork requested after the initial design sketch has been approved and the painting is underway may be possible but may also incur an additional charge. The customer will be advised if this is the case, and payment for any additional work required must be settled in addition to the original outstanding balance and shipping costs before artwork is delivered. |

PERSONAL UPSET, EMOTIONAL/MENTAL STRESS & DAMAGE DISCLAIMER (ALL ARTWORKS)
CARICATURE PORTRAITS, BY NATURE, OFTEN FOCUS ON THE PERSONAL, PHYSICAL ASPECTS OF AN INDIVIDUAL. THE ARTIST, ROB HENDERSON, THE COMPANY "CARICATURE AIRCRAFT PICTURES" NOR ANY THIRD PARTY PRINTERS & THEIR EMPLOYEES USED FOR THE PRODUCTION OF PRINTED COPIES OF ANY ARTWORKS WILL NOT BE HELD RESPONSIBLE FOR ANY PERSONAL UPSET OR OFFENCE TAKEN BY THE PRODUCTION OF A PERSONALISED CARICATURE ARTWORK. IT IS THE RESPONSIBILITY OF THE CUSTOMER MAKING THE ORIGINAL ORDER TO NOTIFY THE ARTIST OF ANY AREAS THAT ARE LIKELY TO CAUSE OFFENCE REGARDING THE CARICATURE PORTRAIT OF ANY INDIVIDUAL TO BE INCLUDED WITHIN THE PAINTING. |

11)
PAYMENT OPTIONS (ALL ARTWORKS)
Payment should be made in UK Pounds Sterling via PayPal. Full details for the making of payments will be provided to the customer along with the final quote for the artwork commission. |

12)
SHIPPING PRICES FOR ORIGINAL ARTWORK
Shipping prices for original artworks to all destinations outside the UK will be quoted for on application. Delivery details will be arranged and shipping costs confirmed with the customer prior to providing the final artwork quote. Postage prices for original artworks within the UK are as stated under "Postage & Shipping". |

13)
PRIVACY: CUSTOMERS CONTACT DETAILS, PHOTOGRAPHS & REFERENCE MATERIAL
Any photographic material of aircraft and/or persons lent by the customer for use as reference by "C.A.P." during the production of a caricature artwork may be copied electronically & kept as reference. Customers photographs will not be reproduced & displayed in public for any reason (including advertising) unless permission has been obtained in writing (not email) from the owner. Copies of customers photographs will neither be lent or sold to any 3rd party individual or organisation whatsoever. Copies of customers photographs may be used in the artist's personal portfolio for the use of private viewing by potential clients. ALL CONTACT DETAILS (POSTAL ADDRESSES, EMAIL ADDRESSES, TELEPHONE NUMBERS), WILL BE KEPT ON RECORD FOR A MAXIMUM PERIOD OF 12 MONTHS / FOR THE DURATION OF ANY PROJECT (WHICHEVER IS THE LONGER TIME PERIOD) PURELY FOR USE BY "C.A.P.". CUSTOMERS CONTACT DETAILS WILL NOT BE FORWARDED ONTO ANY THIRD PARTY OR RELEASED FOR PUBLIC VIEWING FOR ANY REASON WHATSOEVER. |

14)
RETURN OF REFERENCE MATERIAL
All original reference material, photographic or otherwise, will be returned to the customer along with the completed artwork. |

15)
PRODUCTION MATERIALS
All original artwork is produced on high quality 2mm thick art-board, not paper, and is created by hand using a mix of ink, water-colour, Designers Gouache and chalk pastel. All prints are produced on 240gsm card, with measurements as stated in each gallery. |
